QUESTION 1 undermines rights guaranteed by the United States Constitution. Specifically fundamental constitutional rights to a a speedy trial, fundamental constitutional rights to confront one’s accusers, the fundamental constitutional right to be presumed innocent, the fundamental constitutional right to be presumed innocent until proven guilty and the fundamental constitutional right to effective counsel. It allows victims to prevent disclosure of certain information by refusing to participate in interviews or depositions.
